I am directed to refer to your memorandum No.
36/448 of 4th March, 1947, on the subject of the detention
of two Chinese soldiers in the New Territories and to inform
you that the following two persons, namely, Ng Kwai Sang,
aged 28, and Yip Kai Wun, aged 19, now stand committed for
trial on charges of assault with intent to rob, shooting with
intent to cause grievous bodily harm and possession of arms
without a licence.
It is expected that an early date will
be fixed for the trial at the March Sessions of the Supreme
Court, Hong Kong.
Wong Kan, Wong Mun and Wong Cheung, who are
fisherman owning and operating Macao registered fishing junk
No. 9326A "Ngan Lee" armed with five cannon and five rifles
which are not covered by Hong Kong licences and who claim that
they were delivering their catch to Un Long in the New
Territories when attacked by persons whom they thought to be
robbers, have been charged with manslaughter and with possession
of arms without licences.
As the incidents which are the subject of the
prosecutions described above, occurred within the jurisdiction
of this Colony I am to express regret that it is not feasible
to accede to the requests of the Governor of Kwangtung as
transmitted in your memorandum under reference.
